TERMS & CONDITIONS

The following terms and conditions do not affect your statutory rights as a consumer:

You must be aged 18 years or over and have completed either the login procedure or have completed an account application form (available by post) before goods may be despatched. You are responsible for the safekeeping of your user name and password and all orders made under such. You must notify us immediately of any known unauthorised user or any other possible breach in security.

All goods remain the property of TheDrinkShop until payment is received in full. All persons placing an order will be sent a receipted invoice upon request.

You are able to purchase goods using various payment cards via our secure server, which utilises the latest 128-bit SSL encryption technology to inhibit the likelihood of unauthorised access or disclosure.

TheDrinkShop complies with all conditions of The Data Protection Act 1998.
Protecting Your Privacy, Security & Age Verification:

You agree that we may use personal information provided by you in order to conduct appropriate anti-fraud checks and to confirm you are of legal age if purchasing alcohol. Personal Information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.

To ensure that your credit, debit or charge card is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.

If you wish to correct, update or remove any information about you that may be in our records, please send us an email with the details of your request. We do not store any type of credit card information. Apart from outlined above we will not sell, give away or disclose any lists or other data that we may retain and we do not purchase such information from other sources.
Delivery:

You undertake to ensure that all deliveries are taken by person/s aged 18 or over.

Deliveries are made during the hours 07.30 to 17:30 on Monday to Friday and 07.30 to 12:00 on Saturdays. Goods are not able to be returned after the signing of a delivery other than those which are faulty or damaged and these will receive a full refund or a replacement re-despatched free of charge. Telephone numbers MUST be given for the recipient. You may be requested to pay by Bank Transfer not credit or debit card. For full details concerning delivery and our returns policy, please click here. All timed deliveries cannot be guaranteed due to unforeseen circumstances.

Where specific courier instructions are given e.g. leave in porch, round the back etc, you are entirely responsible for goods being received where our couriers have a POD (proof of delivery), and/or inform us that the goods were 'left as instructed'. You must ensure that any specific courier instructions given are correct, and that the information provided, ensures a safe and accurate delivery.

Our European couriers are not able to carry out such courier instructions due to language barrier restraints.

You may be liable to state taxes and/or duties upon arrival in your country.

Rest of the World Deliveries:

You undertake to ensure that all deliveries are taken by person/s aged 18/21 or over, depending on the destination country. You are responsible to ensure alcohol deliveries are permissible in your country. We cannot be held responsible should customs clearance refuse entry of your delivery.

You may be liable to pay local state taxes and/or duties upon arrival in your country/state.

Any additional charges are the buyers responsibility as we have no control over these charges and cannot predict what they may be.

You should contact your local Customs Department if you require further information.

To track your order, please contact us by telephone and our customer service staff will be happy to assist you.

We are unable to accept courier instructions for overseas shipment, such as leave in porch, so please ensure the recipient will be at home or work to accept delivery. Telephone numbers MUST be given for the recipient. You may be requested to pay by Bank Transfer not credit or debit card.

We are unable to deliver to PO Box numbers including BFPO.
Order Cancellation:

You are able to cancel any order made within 7 days after the goods are received. All credits will be issued within 48 hours of the goods being received back to our warehouses.
Returns and Refunds:

On the rare occasions a breakage occurs or goods are faulty, we will offer a replacement or a credit on the return of the items in question. We must be notified of such within three working days and the goods returned within a further seven days and are further happy to have these goods collected by our couriers at no extra cost to yourself. We may require further information from you regarding where the goods may be collected from, if different from the original delivery address or, may be picked up from a particular place. For example, you may leave the goods in a porch or with a neighbour for collection. Claims and details for these are required by post, fax or email.

Should the goods ordered be returned because the couriers have failed to deliver despite all attempts including telephone number given for the recipient and any other helpful information, we will either give you a full credit, or re-despatch on your instruction where the same delivery cost will be charged against your account.

Our couriers will make a single attempt to deliver your parcel and if you/recipient is not at home, they will try immediate the neighbours. Thereafter, you/recipient will need to make arrangements with courier to make a further attempt of delivery or to give alternative instructions, such as leave in the porch. You are also able to collect the goods from your delivering depot who hold the goods for a further 5 working days, before returning the goods to us where you will incur a return delivery charge equal to the amount for that order.

All refunds will be made within 30 days of agreeing such.

All payments in UK sterling (GB pounds).

Circumstances beyond our control: We do not have to keep to these conditions and are not liable if we are prevented or delayed from doing so by: Fire. Severe weather conditions. A shortage or lack of fuel or power supplies. Industrial action (official or unofficial). A delay by any government, public or local authority or customs authority. Hijacking, robbery or other criminal action. Any other causes beyond our control.
Guarantee:

The company undertakes to give you the best service possible but do not accept responsibility for uninterrupted services whilst 'on-line' due to technical problems outside of our control and are therefore unable to guarantee entirely error free services.
TheDrinkShop.com Ltd shall not be liable for loss of wasted expenditure, loss of business, or earnings as a result of using our services.
Cancellation of Services:

We reserve the right to terminate you using our services at any time, for whatever we consider misappropriate or improper use or not abiding by these terms and conditions. You will be informed of such termination in writing.
Copyright:

All rights in the design applications and any items contained within this site including its trademarks, intellectual properties, pictures and any text are solely owned by TheDrinkShop.com Ltd and may not be used for any other purpose.
Credit Terms:

Trade invoices are due for payment by 30 days end of month from the month of invoice (or such other period as may have been agreed in writing between the customer and TheDrinkShop.com Ltd. TheDrinkShop.com Ltd reserve the right to withdraw credit facilities and to charge interest at the rate of 3% over base rate on overdue accounts. TheDrinkShop.com Ltd also reserves the right to refuse to make any further deliveries until such time that any overdue monies are paid. If the buyer fails to pay any one invoice that has become due, then all other unpaid amounts shall become due immediately. In this event, the company reserves the right to withdraw from any further delivery obligations without further notice, and be entitled to claim compensation for any and all damages suffered, including any charges or fees levied to TheDrinkShop.com Ltd's appointed collector of any, and all debts outstanding.

Retention of Title:

Notwithstanding delivery and the passing of risk in the goods or any other provision of these conditions, all goods delivered by TheDrinkShop.com Ltd and the title in any goods shall not pass to the customer until all monies that are outstanding at any time including bank charges, legal fees and collection expenses are paid to TheDrinkShop.com Ltd in full in cash or cleared funds. In this regard the customer grants the right to TheDrinkShop.com Ltd to enter the customer's premises, or in any other premises where the goods are reasonably believed to be stored by the customer when notice has been given to take possesion of the goods, or at any time using such reasonable force, in accordance wih UK law as may be required in the event that access is not permitted for any reason by the customer.
Until such time as title in the goods has passed to the customer, the customer shall hold the goods as TheDrinkShop.com Ltd's fiduciary agent and bailee, and keep the goods properly stored, protected, insured and identified as TheDrinkShop.com Ltd's property. Until that time, the customer shall be entitled to resell or use the goods in the ordinary course of business but shall account to TheDrinkShop.com Ltd for the procceds of sale or otherwise of the goods, whether tangible or intagible, including insurance proceeds and shall keep all such proceeds properly stored, protected and insured.
Until such time as title in the goods passes to the customer (and provided the goods are still in existence and have not been sold). TheDrinkShop.com Ltd shall be entitled at any time to require the customer to deliver up the goods to TheDrinkShop.com Ltd or their agents and, if the customer fails to do so forthwith, to enter upon any premises of the customer or any third party where the goods are stored and repossess the goods. The customer shall not be entitled to pledge or in any way charge by the way of security for any indebtedness any of the goods which remain the property of TheDrinkShop.com Ltd, but if the customer does so all monies owing to TheDrinkShop.com Ltd or the invoicer by the customer shall (without prejudice to any other right or remedy of TheDrinkShop.com Ltd or the invoicer) forthwith become due and payable.
Undertaking:

We shall undertake to correct any inaccuracies so pointed out to us and to amend these as soon as possible.
These conditions shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the courts of England and Wales.
